The Association for Rights in the Arts (the “ARITA”) provides access to and use of its website (the “Website”) subject to the following terms and conditions (the “Terms and Conditions”). By accessing and using the Website, you are acknowledging that you have read, understand, and agree without limitation or qualification, to be bound by these Terms and Conditions. - Legal Consultation Bookings
To book legal consultations, users may either use the SimplyBook.me platform or send a booking email to info@rightsinthearts.org. Membership must be valid at the time of the legal consultation date. In case of new or renewal of membership, payment must be made in advance (by bank transfer) or no later than at the start of the legal consultation (by cash). - Registrations and Cancellations
To register to workshops, conferences and other ARITA events requiring RSVP, users may send a registration email to info@rightsinthearts.org. Registration and payment (if any) must be made as soon as possible, and no later than 5 days before the date of the event. Only requests for cancellations made in writing 5 days before the event will be taken into consideration. Only in cases of cancellation of a paid event, a lump sum of CHF 20.- will be charged to cover our administrative expenses. ARITA reserves the right to modify this amount according to the type of event. After the cancellation period, the registration fee will be due in full, even in case of non-participation at the event. - Disclaimer of Liability
In no event shall ARITA, its Board Members, Interns, Volunteers, Agents and Representatives be liable for any direct or indirect, incidental or other damages whatsoever arising out or in connection with this Website, including service interruption, outside intrusion, IT virus or any event due to force majeure. ARITA expressly disclaims all liability in respect to damages related to information, images and videos provided, presented or displayed on the Website. The Website may contain links to websites operated by third parties. The user acknowledges and agrees that ARITA does not control the websites of third parties and cannot be held responsible for their content, data protection policy or for any other reason. - Data protection
ARITA collects personal information of users of the Website in compliance with the Swiss Federal Act on Data Protection of 19 June 1992 as amended from time to time (n. 235.1, the “Federal Act on Data Protection”). Personal data is treated confidentially and is not transmitted to third parties. - Intellectual Property
The information, images and videos provided, presented or displayed on the Website, and the software used for the Website may contain confidential information or information protected by intellectual property rights. Unless otherwise noted, ARITA retains all intellectual property rights related to the Website or the information, images and videos provided, presented or displayed on the Website, excluding ARITA partner logos published on the Website and information, images and videos reproduced with indication of their source. The Website and any necessary software used in connection with it may contain confidential information protected by the intellectual property regulations in force or any other laws that may apply. It is forbidden to modify the software or to use modified versions of the software and in particular (without this enumeration being restrictive) in order to obtain unauthorized access to the service and to access the Website by means other than by the interface which is provided to you by ARITA. - Cookies
ARITA reserves the right to collect user data, including the use of cookies, in accordance with the Federal Act on Data Protection. Cookies do not allow the identification of the user. Cookies are files that allow to record information about the user’s authentication (by means of the log in) and browsing activity of computers on the ARITA Website (visited pages, date and time of the visit, etc.). This information may be used during your next visit (ARITA user recognition system on the Website) and data may be transmitted to ARITA. We remind you that you may oppose the recording of “cookies” by configuring your browser or opting out on banner which appears on the landing page. - Applicable Law and Place of Jurisdiction
The present Terms and Conditions are governed by Swiss law, without regard to any conflict of law rules. Any dispute or claim arising out of these Terms and Conditions or related to the use of the Website will be heard and resolved exclusively in the courts of the Canton of Zurich, subject to a possible appeal to the Federal Court. - Contact details
